Eve Exchange Terms of Service – Last updated 01/08/2023
app.eve.exchange is a web-hosted interface provided by Eve Exchange. The Eve Exchange Interface provides access to a decentralized protocol deployed on various public blockchains, allowing users to trade, earn, and interact with digital assets. The Eve Exchange interface isn’t the sole method for accessing the protocol. To use the Eve Interface, a non-custodial wallet must be employed. Eve Exchange doesn’t offer wallet solutions.
This Agreement outlines the terms and conditions governing your access and use of the Interface. Carefully read this Agreement in its entirety. By accessing or using the Interface, you confirm that you’ve read, understood, and agreed to abide by this Agreement. If you disagree, you’re not authorized to access or use the Interface.
We retain the right to modify this Agreement. All modifications become effective upon posting, and your continued access or use of the Interface indicates your acceptance of these changes. If you disagree with any modifications, cease accessing and using the Interface immediately.
You’re not buying, selling, or entering contracts for digital assets from the interface; rather, it’s direct peer-to-peer trading through the protocol.
Eligibility
To access or use the Interface, you must be capable of forming a legally binding contract with us. Therefore, you affirm that you’ve reached the age of majority in your jurisdiction. You also represent that your use of the Interface complies with applicable laws and regulations and won’t facilitate any illegal activity.
Restricted users
The interface isn’t available to individuals or entities located or domiciled in the following countries:
United States, Syria, N. Korea, Iran, Puerto Rico, Myanmar, Côte d’Ivoire, Cuba, Congo, Iraq, Libya, Mali, Nicaragua, Somalia, Sudan, Yemen, Zimbabwe.
Proprietary Rights
Eve Exchange possesses all intellectual property and other rights related to the Interface and its contents, including software, text, images, trademarks, service marks, copyrights, patents, and designs.
Additional Rights
We reserve the following rights:
(a) With or without prior notice, modify, replace, remove, or add to the Interface.
(b) Review, modify, filter, disable, delete, and remove content and information from the Interface.
(c) Collaborate with law enforcement, courts, government investigations, or third parties requesting or directing disclosure of information or content provided by you.
Privacy & Third Party Software
We collect your blockchain wallet address, completed transaction hashes, and token information for the assets you trade. We also collect an email address, which is treated in accordance with our Privacy Policy. Third-party chain analysis software may independently access your personal data. We can’t control how these third parties handle your data. Through accessing and using the Interface, you understand and consent to our data practices and our service providers’ handling of your information.
No Connection to Regulated Entities or Others Using the Eve Brand
The interface, provided by Eve Exchange, is unrelated to other services under the Eve brand, including regulated or licensed services. The $EVE token, issued by Eve Exchange, offers interface/protocol discounts. Eve Exchange may partner with projects using the $EVE token, brand, or technology but has no direct relationship beyond the licensing agreement.
$EVE tokens are not shares or securities and have no approved function outside the Eve Ecosystem. The utility of EVE is subject to change.
Not Registered with the SEC or Any Other Agency
Eve Exchange isn’t registered with the U.S. Securities and Exchange Commission or any other regulatory body. We’re not a broker or exchange but facilitate trades on your behalf. All activity occurs on public blockchains; the interface merely enables interaction.
Non-Solicitation; No Investment Advice
Trades made via the Eve Exchange interface are unsolicited, initiated solely by users. We don’t provide investment advice or review trade suitability. Information from the Interface is for informational purposes only and isn’t investment advice.
Non-Custodial
Eve is a non-custodial interface; we don’t hold or access your assets, regardless of their state. You’re responsible for safeguarding cryptographic private keys. We have no fiduciary duties; any such duties are disclaimed.
Prohibited Activity
You agree not to engage in prohibited activities, including copyright infringement, compromising system integrity, fraud, market manipulation, and violating laws or regulations.
Compliance and Tax Obligations
By accessing the Interface, you’re responsible for compliance with relevant laws and regulations in your jurisdiction. Determine and report applicable taxes for transactions you initiate or receive.
Assumption of Risk
By accessing the Interface, you attest to understanding blockchain risks, digital asset intricacies, and irreversible transactions. We’re not liable for risks; Eve Exchange isn’t responsible for protocol losses. You assume responsibility for Interface use risks.
Release of Claims
Users assume all Interface-related risks and interactions with the Protocol. You further expressly waive and release Eve Exchange and affiliates from liability, claims, damages, or losses arising from Interface use.
Indemnity
You agree to indemnify us against claims arising from your Interface use, violation of this Agreement, or aiding others’ Interface use.
No Warranties
The Interface is provided “AS IS” and “AS AVAILABLE.” We disclaim all representations and warranties. Your use is at your risk; we don’t guarantee access quality, accuracy, or error-free use.
Limitation of Liability
We aren’t liable for indirect, punitive, or consequential damages. We assume no liability for errors, unauthorized access, or interruption.
Dispute Resolution
We aim to resolve disputes through informal negotiation. Contact us via email for dispute resolution.
Class Action Jury Trial Waiver and Jurisdiction
Disputes are resolved individually, waiving class actions. Jury trials are waived.
Entire Agreement
This Agreement constitutes the entire understanding between you and us, superseding prior agreements.

Eve DeFi Exchange Interface & Protocol Disclaimer
Eve DeFi is a decentralized peer-to-peer protocol and interface that people can use to create liquidity and trade ERC-20 tokens on the Polygon network. Eve DeFi is made up of smart contracts that are deployed publicly on the Polygon network and other networks. Before using the Eve DeFi Exchange interface, you should review our terms and conditions and relevant documentation to make sure you understand how the Eve DeFi Exchange interface works. You may be able to access the Eve DeFi Exchange protocol through multiple web or mobile interfaces. You are responsible for doing your own diligence on those interfaces to understand the fees and risks they present. THE EVE DEFI EXCHANGE INTERFACE IS PROVIDED "AS IS", USE AT YOUR OWN RISK, EVE PROVIDERS NO WARRANTIES OF ANY KIND. Eve DeFi is run by smart contracts deployed on the Polygon Network and potentially others, any user can post any token for sale, including invented tokens, beware of “fake” tokens and confirm what you are buying. No developer or entity, manager or affiliate involved in creating the Eve DeFi Exchange protocol or Interface will be liable for any claims or damages whatsoever associated with your use, inability to use, or your interaction with other users of, the Eve DeFi Exchange interfacel, including any direct, indirect, incidental, special, exemplary, punitive or consequential damages, or loss of profits, cryptocurrencies, tokens, or anything else of value.
Options trading and USA based users: The options trading element of the interface is not offered to persons or entities residing in or incorporated within the United States of America. No exceptions are made. Do not attempt to use our options trading contracts if you are a US person. Use of VPN for the goal of circumventing these restrictions is prohibited.
